Desertion typically involves the intent to leave one’s unit or place of duty permanently, but an offender who is AWOL for 30 days automatically is considered to have deserted his or her post (without proof of intent).

What makes a soldier AWOL?

When a serviceman leaves the military without prior authorization, it is considered an Absence Without Leave (AWOL) or Unauthorized Absence (UA). Also known as desertion, it is no light matter and can lead to serious consequences.

How do you know if you’re AWOL?

AWOL means that you are absent from work without your employer’s permission – it’s an unexecuted absence. The length of the absence doesn’t matter. You can be AWOL if you show up an hour late or if you don’t come to work for a week. Employees may be charged with AWOL in many circumstances.

What kind of discharge is AWOL?

If the member is in absence from their un, organization, or another place of duty for more than 30 days and the AWOL is terminated by apprehension: dishonorable discharge, forfeiture of all pay and allowances, reduction to the lowest enlisted grade, and confinement for 18 months.

Is desertion the same as AWOL?

Absent without leave (AWOL) and desertion are similar in that military members are not where they are supposed to be at a given time, but the two terms are not interchangeable. The main difference between the two is time. Usually, after one month of being AWOL, a military member can be considered a deserter.

Is going AWOL a felony?

The key difference between them is that AWOL/UA is a misdemeanor, while desertion is a felony that assumes the missing soldier abandoned the service with the intent never to return.

How many soldiers go AWOL each year?

AWOL and Desertion charges are not uncommon in the military with the Army accumulating anywhere between 2,500 and 4,000 annually.

Can AWOL get certificate of employment?

If the employer stated on your COE that you went AWOL, or was terminated for just causes and you wanted to scratch that out, you may REQUEST them to do so, but in no way can you force them to rewrite the Certificate of Employment if they refuse. The COE is the employer’s certification, NOT yours.

Does AWOL show up on a background check?

There probably is a deserter warrant out for your arrest, it won’t show on a criminal background check. The longer you wait to take care of the matter, the worst it will end up for you.

How long can an employee be absent from work?

There is no statutory definition of “a reasonable time” but it is generally considered that 3 to 5 days fulfills the definition. Quite obviously, you must follow disciplinary procedures (in absentia if necessary) before dismissing the employee.

Absence without leave (AWOL) includes unapproved absences from duty or resignations. This gives employers the right to terminate their employee’s services as long as they comply with due process.

In order to justify a dismissal, based on absenteeism, the employer needs to prove that the absences were of an unreasonable duration or that they were frequent enough to disrupt work within the company.

Involuntary absenteeism includes sick children at home, personal illness, funeral attendance or other unavoidable situations. An example of voluntary absenteeism is a “mental health day.” Some businesses do not differentiate between involuntary and voluntary absenteeism, instead a “no fault policy” is put into place.

It is evident that both absent and unproductive/distracted employees are costly to your business and negatively impact your bottom line. Frequent absenteeism does not only have monetary effects, but it can also negatively impact employee morale and your overall productivity levels.
